IMPORTANT: By agreeing to this waiver at checkout, you waive certain legal rights, including in some circumstances the right to sue. Please read carefully before ticking the box.
1. Definitions
In this Waiver:
- "TFC" means The Foot Collective Pty Ltd (ABN 16 629 674 004), its directors, officers, employees, agents, and independent contractors.
- "BSA" means Barefoot Shoes Australia Pty Ltd (ABN 37 650 918 826), its directors, officers, employees, and agents.
- "Organisers" means TFC and BSA jointly, as co-organisers of the Event.
- "Event" means the Barefoot Shoe & Foot Health Expo Australia 2026, held at the Stamford Sydney Airport Hotel & Conference Centre, Sydney NSW, on Saturday 8 August 2026, including the Friday 7 August 2026 networking event and all associated workshops, movement sessions, and activities.
- "Facilitator" means any person engaged by the Organisers to deliver workshops, presentations, movement sessions, or other activities at the Event, whether a TFC employee, independent contractor, certified TFC Guide, or external presenter.
- "Exhibitor" means any third-party brand, business, or individual operating a booth or display at the Event independently of the Organisers.
- "Participant", "I", "me" and "my" refers to the individual taking part in the Event.
2. Nature of the Event
The Barefoot Shoe & Foot Health Expo is a public consumer expo featuring exhibitor booths, footwear brands, educational workshops, and movement sessions. Workshops and movement room sessions involve physical activity and are delivered by Facilitators engaged by the Organisers.
Exhibitors are independent businesses operating their own booths. They are not agents, employees, or representatives of the Organisers.
3. Voluntary Participation and Assumption of Risk
I confirm that:
- My attendance at the Event is voluntary and I may withdraw from any activity at any time
- I understand that workshops, Play/Movement Room sessions, and any physical demonstrations carry inherent risks, including but not limited to: slips, trips, falls, strains, sprains, soft tissue injuries, and in rare cases more serious injury or death
- I freely and knowingly assume all such risks, whether arising from the negligence of the Organisers, their employees, Facilitators, or otherwise
- General attendance at the expo floor also carries venue risks including slips, trips, and falls, which I freely assume
4. No Medical or Therapeutic Services
I acknowledge that Event workshops and movement sessions are educational and movement-based in nature. They do not constitute medical advice, clinical assessment, diagnosis, or treatment. Facilitators are not providing clinical services in their capacity as Event presenters.
5. Release and Waiver of Liability
To the fullest extent permitted by applicable law, I hereby release, discharge, and hold harmless TFC, BSA, and their respective directors, officers, employees, contractors, Facilitators, agents, successors, and assigns from any and all claims, demands, damages, costs, expenses, actions, and causes of action of any kind — whether in law or equity — arising out of or in connection with my attendance at or participation in the Event, including but not limited to:
- Personal injury or death
- Property damage or loss
- Any act or omission (including negligence) of the Organisers, their employees, contractors, or Facilitators
This release does not apply to liability that cannot be excluded under the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)), including non-excludable consumer guarantees.
6. Exhibitor Independence
I acknowledge that Exhibitors operating at the Event are independent businesses acting on their own behalf. The Organisers are not responsible for the activities, products, representations, demonstrations, advice, or omissions of any Exhibitor. Claims arising from an Exhibitor's activities are a matter between the Participant and that Exhibitor.
7. Indemnity
I agree to indemnify and keep indemnified the Organisers and their representatives against any and all claims, demands, damages, costs, and expenses (including legal fees on a full indemnity basis) arising from:
- My attendance at or participation in the Event
- My breach of this Waiver
- My negligence or misconduct
- Any claim by a third party arising from my actions during the Event
8. Fitness to Participate
I confirm that:
- I understand that workshops and movement sessions involve physical activity and I will only participate in activities I am physically able to perform
- I will inform the Facilitator of any relevant medical conditions, injuries, or physical limitations before participating in any workshop or movement session
- I will stop participating immediately and seek medical assistance if I experience pain, dizziness, discomfort, or any concerning symptoms
9. Photography, Video, and Online Foot Health Summit
The Organisers and their representatives may photograph and video record the Event for promotional and educational purposes.
Online Foot Health Summit: Workshops delivered at this Event may be recorded and released commercially as the TFC Online Foot Health Summit, a paid digital product. By purchasing a ticket, you consent to the possibility of being captured in workshop recordings made for this purpose.
If you do not wish to appear in photographs, video footage, or workshop recordings:
- For general photography on the expo floor: notify Event staff at the registration desk and the Organisers will use reasonable efforts to avoid knowingly capturing your image.
- For workshop recordings: notify the Facilitator before the session begins and take a position away from the primary camera.
You may withdraw media consent (for content not yet published) by contacting [email protected]. The Organisers cannot remove content already published before withdrawal is received.
10. Governing Law and Jurisdiction
This Waiver is governed by the laws of the State of New South Wales, Australia. Australian Consumer Law rights apply regardless of this clause.
11. Purchasing on Behalf of Another Person or a Child
Purchasing for another adult: By ticking at checkout, you confirm that you have made the participant aware of this waiver and its contents before completing the purchase.
Purchasing for a child under 18: By ticking at checkout, you confirm that as their parent or legal guardian you accept this waiver on their behalf. You further confirm that you will be present with the child during any physical activity, including workshops and the movement Room.
12. Privacy
Information provided during ticket purchase is handled in accordance with TFC's Privacy Policy at https://thefootcollective.com/policies/privacy-policy.
